These Terms of Service (“Terms”) govern your use of the Miami Custom Depot Inc. website, online store, and related products and services.
Throughout these Terms, “Miami Custom Depot,” “Custom Depot,” “we,” “us,” and “our” refer to Miami Custom Depot Inc. “Customer,” “you,” and “your” refer to any person or organization accessing our website, requesting a quote, submitting artwork, or purchasing products or services from us.
By accessing our website, submitting an order, approving a proof, or purchasing products or services from Miami Custom Depot, you agree to these Terms.
1. Our Services
Miami Custom Depot provides custom printing, personalization, decoration, promotional products, apparel, and related services.
Services may include:

Product and service availability may change without notice.
2. Custom Orders
Most Miami Custom Depot products are produced specifically for each customer.
Customers are responsible for reviewing all order information before submitting or approving an order, including:

Once production begins, changes may not be possible.
3. Quotes and Pricing
Prices displayed online or provided through a quote are based on the information available at the time the price is provided.
Pricing may vary depending on:

Artwork requirements

Applicable taxes
Quotes may have an expiration date. If no expiration date is stated, Miami Custom Depot reserves the right to revise pricing before an order is accepted or paid.
Obvious typographical, technical, or pricing errors do not obligate Miami Custom Depot to fulfill an order at the incorrect price. If an error affects an order, we will contact the customer before proceeding whenever reasonably possible.
4. Payment
Payment requirements may vary depending on the order.
For custom orders requiring a deposit, Miami Custom Depot may require a 50% deposit before artwork preparation, product ordering, or production begins. The remaining balance must be paid according to the terms stated on the applicable quote or invoice and, unless otherwise agreed, before or at pickup.
Online orders may require full payment when the order is placed.
Orders are not considered confirmed until the required payment or deposit has been received.
Miami Custom Depot may suspend production, pickup, delivery, or shipment when an outstanding balance remains unpaid.
5. Artwork and Design Proofs
Certain custom orders require an artwork proof before production.
A proof is intended to allow the customer to review elements such as:

-

-
Numbers
-
Spelling
-
Dates
-
General colors
-
Personalization
The customer is responsible for carefully reviewing the proof before approving it.
When a customer approves a proof, the customer confirms that the artwork and information shown are acceptable for production.
Miami Custom Depot is not responsible for customer-approved errors, including spelling mistakes, incorrect names, dates, numbers, artwork, or other information that appeared on the approved proof.
Changes requested after proof approval may result in additional fees and production delays.
6. Artwork Colors and Product Colors
Colors displayed on computer monitors, phones, tablets, photographs, mockups, and digital proofs may differ from the final printed or embroidered product.
Differences may result from screen calibration, garment material, garment color, printing method, ink, thread, transfer material, lighting, photography, or manufacturing variations.
Digital proofs are therefore intended primarily to show design, layout, and approximate placement rather than guarantee an exact color match.
If an exact or specific color match is important, the customer should notify Miami Custom Depot before approving production.
7. Print Placement and Production Variations
Custom apparel and promotional products are produced using manual and mechanical processes.
Minor variations in placement, size, alignment, color, texture, garment construction, stitching, transfer appearance, or other production characteristics may occur.
Reasonable production variations are not considered defects.
8. Customer-Supplied Artwork
Customers may submit logos, photographs, illustrations, trademarks, names, designs, text, or other content for reproduction.
By submitting artwork or other content, the customer represents that they own the content or have permission or legal authority to reproduce it.
The customer is responsible for obtaining any necessary licenses, permissions, or authorizations.
Miami Custom Depot may refuse artwork or content that we reasonably believe:

Violates intellectual property rights

Is unlawful
-
Is fraudulent or deceptive
-
Contains prohibited content
-
Cannot be safely or appropriately reproduced
The customer's submission of artwork does not transfer ownership of that artwork to Miami Custom Depot.
9. Copyright and Trademark Responsibility
Miami Custom Depot does not independently verify ownership of every logo, image, trademark, photograph, character, design, or other item submitted by customers.
Customers are responsible for ensuring that their requested reproduction is legally authorized.
The customer agrees to be responsible for claims arising from content supplied by the customer when the customer did not have the necessary rights or authorization to reproduce that content, to the extent permitted by applicable law.
10. Design Work Created by Miami Custom Depot
Unless otherwise agreed in writing, preliminary concepts, proofs, layouts, mockups, production files, and other design work created by Miami Custom Depot remain our property until applicable design fees and agreed charges have been paid.
Payment for a printed product does not automatically include ownership or delivery of editable source files, production files, embroidery files, or other working files unless specifically included in the order.
Customer-provided original artwork remains the property of the customer or applicable rights holder.
11. Production and Turnaround Times
Standard production times are estimates and may vary depending on the product, quantity, artwork approval, inventory, decoration method, and workload.
A typical standard production period may be approximately 5–7 business days after payment, final order confirmation, and artwork approval, unless otherwise stated.
Production time generally does not include shipping transit time.
Orders requiring special products, large quantities, complex artwork, embroidery, specialty decoration, or outsourced components may require additional time.
Turnaround estimates begin only after all required information, payment, products, and proof approvals have been received.
12. Rush Orders
Rush service may be available for qualifying orders.
Rush availability depends on inventory, production capacity, artwork readiness, quantity, and decoration method.
Additional rush fees may apply.
Payment of a rush fee accelerates production according to the agreed schedule but does not guarantee carrier delivery times after an order leaves our facility.
Customers should communicate firm event dates or deadlines before placing an order.
13. Product Availability and Substitutions
Garment colors, sizes, brands, styles, and promotional products are subject to supplier availability.
If an ordered item becomes unavailable, Miami Custom Depot may contact the customer to offer:

A comparable substitute
-
Another color
-
Another size or style
-
A revised production schedule
-
A refund for the unavailable item when appropriate
We will not knowingly substitute a materially different product without customer approval when the substitution significantly changes the order.
14. Garment and Manufacturer Variations
Garments and other products may have normal manufacturing variations in dimensions, shade, texture, fabric composition, stitching, or construction.
Different production lots of the same garment color may have slight shade variations.
Manufacturer specifications and measurements may also change.
These normal manufacturing variations are outside Miami Custom Depot's control and are not considered printing defects.
15. Customer-Supplied Garments and Products
Miami Custom Depot may, at its discretion, accept customer-supplied garments or products for decoration.
Printing, embroidery, heat application, sublimation, engraving, or other customization involves inherent production risks.
Unless otherwise agreed in writing, Miami Custom Depot's liability for accidental damage to an accepted customer-supplied item will not exceed the reasonable replacement value of that item, subject to applicable law.
Irreplaceable, sentimental, vintage, rare, or unusually valuable items should not be submitted for customization unless the risk has been specifically discussed and accepted.
16. Customized Products and Returns
Because customized and personalized products are made specifically for each customer, they generally cannot be returned or exchanged because of:

Incorrect size selected by the customer

Change of mind
-
Customer-approved artwork
-
Customer-approved spelling or personalization
-
Customer-selected colors
-
Customer ordering the wrong product or quantity
If Miami Custom Depot makes a verified production error or provides a defective customized product, we will evaluate the issue and provide an appropriate remedy, which may include reprinting, replacement, correction, or store credit depending on the circumstances.

17. Order Cancellations
Cancellation requests should be made as soon as possible.
Orders may become non-cancellable once Miami Custom Depot has:

Ordered special merchandise

Begun artwork or digitizing services
-
Produced transfers
-
Started embroidery
-
Started printing or customization
-
Otherwise incurred non-refundable costs for the order
Approved cancellations may be subject to charges for work already completed, products purchased, design services, processing expenses, or other non-recoverable costs.
18. Shipping
Shipping times are estimates and are separate from production times.
Once an order is transferred to a shipping carrier, delays caused by weather, carrier operations, incorrect addresses, transportation interruptions, or other circumstances outside Miami Custom Depot's reasonable control may affect delivery.
Customers are responsible for providing an accurate and complete shipping address.
Additional shipping charges may apply when a package must be redirected or reshipped because the customer supplied incorrect information.
19. Local Pickup
Customers selecting local pickup will be notified when their order is ready.
Customers should not arrive for pickup based solely on an estimated completion date unless they have received confirmation that the order is ready.
Orders should be inspected within a reasonable period after pickup.
20. Order Problems
Customers should inspect their order promptly after pickup or delivery.
If you believe Miami Custom Depot made a production error or an item arrived defective, contact us promptly and provide:

Photographs showing the issue

Quantity affected
We may request that affected merchandise be returned or made available for inspection before approving a remedy.
21. Care of Decorated Products
Customers are responsible for following applicable garment and decoration care instructions.
Damage caused by improper washing, excessive heat, bleaching, ironing directly over decoration, misuse, or failure to follow care instructions is not considered a production defect.
22. Website Information
We make reasonable efforts to provide accurate product descriptions, images, pricing, sizing, availability, and other website information.
However, website information may occasionally contain errors or become outdated.
We reserve the right to correct errors, update information, modify products, or cancel an affected transaction when necessary, subject to applicable law.
23. Prohibited Use
You may not use our website or services to:

Violate applicable laws

Infringe intellectual property rights

Submit fraudulent information
-
Attempt unauthorized access to our systems

Distribute malicious software
-
Interfere with website operation

Engage in fraudulent payment activity

Use our services for unlawful purposes
We reserve the right to refuse or terminate service where reasonably necessary to protect Miami Custom Depot, our customers, or third parties.
24. Third-Party Services
Our store may use Shopify and other third-party services for ecommerce, payments, shipping, communications, analytics, marketing, and other functions.
Those services may have separate terms and privacy policies governing their platforms.
Miami Custom Depot is not responsible for third-party systems or services outside our reasonable control.
25. Limitation of Liability
To the maximum extent permitted by applicable law, Miami Custom Depot will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website, products, or services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
26. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Miami Custom Depot Inc. harmless from third-party claims, damages, or reasonable expenses arising from artwork or other content you supplied when you did not have the required rights or authorization to reproduce that content, or from your unlawful misuse of our services.
27. Privacy
Personal information collected through our website and services is handled according to our Privacy Policy.
By using our website or services, you acknowledge that you have reviewed the applicable Privacy Policy.
28. Governing Law
These Terms are governed by the laws applicable in the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or another mandatory law controls.
29. Changes to These Terms
Miami Custom Depot may update these Terms periodically to reflect changes in our products, services, policies, technology, or legal requirements.
The latest version will be posted on our website with an updated revision date.
Continued use of our website and services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
