Miami Custom Depot Inc. (“Miami Custom Depot,” “Custom Depot,” “we,” “us,” or “our”) provides custom printing, embroidery, personalization, design, and promotional product services. Customers may submit artwork, logos, photographs, text, trademarks, designs, and other materials for reproduction.
This Artwork, Copyright & Trademark Policy explains the customer's responsibilities when submitting content and how Miami Custom Depot handles customer artwork and design files.
By submitting artwork, approving a proof, or placing an order that requires reproduction of customer-provided content, you agree to this policy.
1. Customer Responsibility for Submitted Artwork
Customers are responsible for ensuring they have the legal right or appropriate authorization to reproduce any artwork or content submitted to Miami Custom Depot.
This includes:

Logos
-
Business names
-
Trademarks
-
Photographs
-
Illustrations
-
Drawings
-
Graphics
-
Characters
-
Team logos
-
School logos
-
Organization logos
-
Artwork downloaded from the internet
-
Purchased artwork
-
Fonts
-
Slogans
-
Music, movie, television, or entertainment-related artwork
-
AI-generated artwork
-
Other copyrighted or protected content
Submitting a file to Miami Custom Depot does not establish that the customer owns or has permission to reproduce it.
2. Customer Authorization
By submitting artwork or requesting that Miami Custom Depot reproduce particular content, the customer represents that they:

Own the applicable rights to the content; or
-
Have obtained permission, a license, or other legal authorization to reproduce the content.
The customer authorizes Miami Custom Depot to reproduce the submitted material only as reasonably necessary to provide the requested products and services.
3. Copyrighted Characters and Entertainment Properties
Many popular characters, logos, images, and designs are protected by copyright or trademark law.
Examples may include characters or artwork associated with:

Movies
-
Television programs
-
Cartoons
-
Video games
-
Comic books
-
Professional sports
-
Musicians
-
Celebrities
-
Entertainment companies
-
Toy brands
-
Theme parks
-
Other commercial properties
Purchasing an image online or finding an image through an internet search does not necessarily give the purchaser the right to reproduce it commercially.
Miami Custom Depot reserves the right to request evidence of permission or refuse an order involving protected content when appropriate.
4. Business Logos and Trademarks
Customers ordering products featuring a company, organization, brand, or other trademarked logo represent that they are authorized to use that logo for the requested merchandise.
Miami Custom Depot may request additional information or authorization when appropriate.
We reserve the right to refuse reproduction of a trademark or logo when we reasonably believe the requested use may be unauthorized or unlawful.
5. Schools, Teams, Universities, and Organizations
School names, mascots, athletic logos, professional team logos, college and university marks, and organizational emblems may be protected by copyright or trademark rights.
Customers requesting these designs are responsible for obtaining any necessary authorization.
Miami Custom Depot's ability to technically reproduce a logo does not mean that the logo is free to use.
6. Photographs and Images of People
Customers submitting photographs or images of identifiable individuals are responsible for obtaining any permissions or releases required for the intended use.
This is particularly important when photographs are being reproduced for:

Commercial merchandise

Promotional products
-
Advertising
-
Fundraising
-
Business marketing
-
Public distribution
Customers should exercise particular care when submitting photographs of minors.
7. Artwork Found Online
Images available through search engines, social media, Pinterest, websites, or other online sources may still be protected by copyright or trademark law.
The fact that an image can be downloaded does not necessarily mean it can legally be printed on merchandise.
Customers are responsible for determining whether they have appropriate rights before submitting such artwork.
8. AI-Generated Artwork
Miami Custom Depot may accept artwork created using artificial intelligence tools.
Customers are responsible for ensuring that their use of AI-generated artwork complies with applicable laws and the terms governing the tool used to create it.
Miami Custom Depot does not guarantee that AI-generated artwork is eligible for copyright protection or that it is free from similarities to existing copyrighted or trademarked material.
We may refuse AI-generated artwork that appears to infringe third-party rights or otherwise violates this policy.
9. Right to Refuse Artwork
Miami Custom Depot reserves the right to refuse, suspend, or cancel an artwork request when we reasonably believe the content:

Infringes copyright

Infringes trademark rights
-
Violates another person's intellectual property rights
-
Is fraudulent or deceptive
-
Is unlawful
-
Violates applicable regulations
-
Cannot be safely or appropriately produced
-
Creates unreasonable legal or operational risk
Refusal to reproduce artwork does not mean Miami Custom Depot has made a legal determination regarding ownership.
When ownership or authorization is uncertain, we may ask the customer to provide documentation or alternative artwork.
10. Customer Responsibility for Intellectual Property Claims
Customers are responsible for artwork and content they provide.
To the extent permitted by applicable law, customers agree to be responsible for third-party claims, damages, or reasonable expenses resulting from customer-submitted content when the customer did not have the required rights or authorization to reproduce that content.
Nothing in this section creates liability beyond what is permitted under applicable law.
11. Customer-Owned Artwork
Original artwork provided by a customer remains the property of the customer or the applicable rights holder.
Submitting artwork to Miami Custom Depot does not transfer ownership of that artwork to us.
The customer grants Miami Custom Depot the limited permission necessary to:

Prepare artwork

Create proofs
-
Prepare production files
-
Print or decorate products
-
Fulfill the order
-
Maintain reasonable production and order records
-
Address customer service issues relating to the order
12. Artwork Created by Miami Custom Depot
Miami Custom Depot may provide design assistance, artwork creation, layout, logo cleanup, vector conversion, personalization, or other creative services.
Unless otherwise agreed in writing, payment for customized merchandise does not automatically transfer ownership of Miami Custom Depot's editable design files, templates, working files, production files, or other internal production assets.
If a customer purchases a separate design service that specifically includes ownership or delivery of final artwork files, the applicable quote or agreement will identify what files and usage rights are included.
13. Free Design Assistance
Miami Custom Depot may offer free artwork or design assistance with qualifying product orders.
Free design assistance is intended to support production of merchandise ordered from Miami Custom Depot.
Unless specifically stated otherwise, free design assistance does not include:

Unlimited design revisions

Editable source files
-
Production files
-
Commercial branding packages
-
Logo ownership transfers
-
Embroidery digitizing files
-
Unlimited future use of Custom Depot-created templates
Additional design work may require a separate fee.
14. Artwork Proofs
When a proof is provided, customers are responsible for reviewing it carefully before approval.

Artwork

Layout

-
Personalization
-
General colors
-
Overall design
Approval of a proof authorizes Miami Custom Depot to proceed with production.
Customer-approved errors are generally not considered Miami Custom Depot production errors.
15. Proof Colors
Colors shown on digital proofs are approximate.
Actual colors may vary because of:

Monitor or phone settings
-
Garment color
-
Fabric composition
-
Printing process
-
Ink
-
Transfer material
-
Sublimation process
-
Thread color
-
Lighting
-
Product surface
A digital proof should not be considered a guarantee of an exact physical color match unless a specific color-matching service has been agreed upon.
16. Artwork Quality
The quality of the finished product depends in part on the quality of the artwork supplied.
For best results, customers should provide high-quality artwork whenever possible.
Preferred formats may include:

Vector artwork such as AI, EPS, SVG, or print-ready PDF
-
High-resolution PNG
-
High-resolution transparent-background artwork
-
Other production-ready files approved by Miami Custom Depot
Low-resolution artwork may appear blurry, pixelated, rough, or distorted when enlarged.
17. Low-Resolution Files
If a customer supplies low-resolution artwork, Miami Custom Depot may:

Request a higher-resolution file
-
Recommend artwork cleanup
-
Recommend vector conversion
-
Offer design assistance
-
Produce the artwork as submitted after customer approval
-
Refuse the artwork if acceptable production quality cannot reasonably be achieved
If a customer approves the use of low-quality artwork after being advised of potential quality limitations, resulting pixelation or similar source-file limitations are not considered production defects.
18. Artwork Cleanup and Recreation
Some customer files may require additional preparation before production.
This may include:

Background removal
-
Vector conversion
-
Redrawing
-
Color separation
-
Resolution improvement
-
Logo cleanup
-
Text recreation
-
Layout changes
-
Print preparation
Simple preparation may be included with qualifying orders.
Complex artwork recreation or extensive design work may require an additional fee. The customer will be informed when reasonably possible before chargeable design work begins.
19. Embroidery Digitizing
Embroidery requires specialized production files that convert artwork into stitch instructions.
An image file such as PNG, JPG, PDF, or SVG is not itself an embroidery production file.
Miami Custom Depot may create or obtain embroidery digitizing files such as DST or other machine-compatible formats.
Unless specifically included in the customer's purchase or agreed in writing, embroidery digitizing and production files created or obtained by Miami Custom Depot remain internal production files and are not automatically provided to the customer.
Digitizing fees compensate for preparation of the design for embroidery and do not necessarily constitute the purchase of the underlying digitizing file.
20. Production Files
Production may require Miami Custom Depot to create specialized files, including:

DTF production layouts

Gang sheets
-
Color separations
-
Cut files
-
Embroidery files
-
Print-ready layouts
-
Sublimation templates
-
UV-DTF layouts
-
Laser or engraving files
-
Internal production templates
Unless specifically purchased or otherwise agreed in writing, these files remain Miami Custom Depot production assets.
21. Fonts
Customers requesting a specific commercial font are responsible for ensuring appropriate licensing when required.
If Miami Custom Depot does not have access to a requested font, we may ask the customer to supply appropriately licensed artwork with the text converted to outlines or select an alternative font.
22. Artwork Storage
Miami Custom Depot may retain artwork and production files for convenience in handling reorders and customer service.
We do not guarantee permanent storage of customer artwork or production files.
Customers should maintain their own copies of original artwork.
A previous order does not guarantee that every file associated with that order will remain available indefinitely.
23. Reorders
When artwork is available, Miami Custom Depot may use previously approved artwork to simplify a reorder.
However, customers should review new order information carefully because products, garment colors, print materials, suppliers, equipment, and production processes may change over time.
A reorder is not guaranteed to be visually identical to a previous production run.
24. Portfolio, Website, and Social Media Use
Miami Custom Depot will not treat a customer's submission of artwork as automatic permission to transfer ownership of that artwork.
We may request permission to photograph or display completed products for our portfolio, website, social media, advertising, or promotional materials.
When an order contains confidential, private, unreleased, or otherwise sensitive artwork, customers should notify Miami Custom Depot before production.
Where separate permission is required by applicable law or agreement, we will obtain that permission before using customer-owned content for promotional purposes.
25. Confidential Business Artwork
If you submit unreleased branding, confidential business materials, private event artwork, or other sensitive content, please notify Miami Custom Depot when submitting the order.
We will use reasonable care when handling such materials as part of the production process.
Customers requiring formal confidentiality obligations should discuss those requirements with us before submitting confidential materials.
26. Copyright Complaints
If you believe Miami Custom Depot has reproduced or displayed material that infringes your intellectual property rights, contact us with sufficient information to identify the material and explain your rights.
Please include:

Your name and contact information

Identification of the copyrighted or trademarked work

Identification of the allegedly infringing material

Explanation of your ownership or authority
-
Supporting documentation when available
We will review legitimate intellectual property complaints and take appropriate action when required.
27. Relationship to Other Policies

If a specific written quote or agreement contains additional artwork requirements, those requirements may also apply to that order.
28. Changes to This Policy
Miami Custom Depot may update this policy periodically to reflect changes in technology, production methods, intellectual property practices, business operations, or applicable law.
The current version will be posted on our website with an updated revision date.
